Acceptable Use Policy — DLX Device Distribution Program
Kansas ADOPT 2.0 Equipment Distribution Program
KC Digital Drive manages a Kansas ADOPT Equipment Distribution Program in partnership with Digital Life Exchange (DLX) member organizations and with technical support provided by TechConnect KC (collectively referred to below as the "Providers").
About Your Device
Through this program, the Participant is receiving a laptop or Chromebook at no cost to support access to education, employment, healthcare, and other essential online services.
The device is provided through a federally funded program administered by KC Digital Drive. KC Digital Drive maintains records of program devices as required by federal grant guidelines.
Participants are not expected to return the device under normal circumstances.
By signing this agreement, the Participant acknowledges and agrees to the program guidelines outlined below.
1. Participant Responsibilities
Participants agree to use and care for the device responsibly.
- Care and Maintenance: Participants are responsible for taking reasonable care of the device and charger. Normal wear and tear is expected. If the device becomes damaged or stops working properly, the Participant should notify the program administrator or support provider.
- Reporting Loss or Theft: Participants should report any loss, theft, or significant damage to the program administrator as soon as possible.
- Personal Data: Participants are responsible for maintaining the security and backup of any personal files or data stored on the device. If requested, the program's technical support provider can assist with removing personal information from the device.

Program Surveys: Participants are asked to complete occasional surveys related to the program. These surveys help Providers understand how devices are being used and improve digital access services in the community.
Failure to complete the required monthly surveys through December 2026 may affect eligibility for future programs or device replacements. -
Program Communications: By signing this agreement, the Participant consents to receiving informational text messages from KC Digital Drive's Digital Life Exchange (DLX) Device Distribution Program related to their participation. Messages may include appointment reminders, device updates, support information, and program communications.

2. Use Guidelines
Participants agree to use the device in a safe and responsible manner.
- Appropriate Use: The device should not be used for illegal activities or in ways that could cause harm to others, property, or digital systems.
- Household Use: The device is intended primarily for the Participant's use, though reasonable household use may be permitted.
- Intended Use: The device should not be used for commercial resale or other activities outside the intended scope of this program without prior approval.
3. Program Compliance
Failure to follow program guidelines may affect eligibility for future programs or device replacements.
In rare circumstances, such as device replacement, repair needs, or grant compliance requirements, KC Digital Drive may request that a device be returned or exchanged.
4. Device Management and Security
Devices may include security measures such as password protection, encryption, antivirus software, or other safeguards to protect sensitive data and ensure responsible program use.
KC Digital Drive maintains an inventory system to track devices distributed through the program as required by federal grant guidelines.
5. Technical Support and Services
Technical support may be provided through TechConnect KC or other authorized providers.
- Reasonable Efforts: Providers will make reasonable efforts to assist Participants with device or software issues. However, results may vary depending on the device, installed software, or other factors beyond the Providers' control.
- System Changes: Technical support may involve making system adjustments that could affect performance or usability.
- Data Recovery: Participants understand that restoration of data or recovery of files cannot be guaranteed.
All services are provided "as is" and "as available." Providers make no guarantees that any issue will be resolved, that systems will operate without interruption, or that data will remain intact.
Participants use these services at their own risk.
6. Limitation of Liability and Indemnification
The Participant agrees to hold harmless and indemnify the partner agency, KC Digital Drive, TechConnect KC, and their officers, employees, agents, volunteers, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:
- the Participant's use or misuse of the device
- any loss of data or system interruption
- damage or harm caused by actions taken using the device
This provision does not apply in cases of gross negligence or intentional misconduct by the Providers.
7. Federal Grant Compliance
This device was distributed through the Kansas ADOPT Equipment Distribution Program, which is funded through federal grant resources administered by the State of Kansas.
Under federal grant requirements, KC Digital Drive must maintain program records for devices distributed through this program. As a result:
- The device remains part of KC Digital Drive's federally funded program inventory for compliance and reporting purposes.
- KC Digital Drive may periodically request basic confirmation that the device is still in use for program reporting or audit requirements.
- Participants may be contacted to verify device use or respond to brief program surveys.
In rare situations involving device replacement, program integrity, or federal audit requirements, KC Digital Drive may request that a device be returned or exchanged.
